These Terms & Conditions ("Terms") govern your use of The Peak mobile application and website (collectively, the "Service") operated by Peak Media LTD EOOD("The Peak", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

The Peak provides personalized Kegel exercise programs for men's health through a mobile application. Our service includes guided workouts, progress tracking, daily challenges, educational content, and insights related to pelvic floor health and overall wellness.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3. Subscription Plans

We offer the following subscription plans:

• 1-Week Plan: $5.50/week (introductory price)
• 1-Month Plan: $11.99/month (introductory price)
• 3-Month Plan: $21.49/3 months (introductory price)

After the introductory period, subscriptions renew at the standard rate unless cancelled before the renewal date. Prices may vary by region and are subject to change with notice.

4. Payment & Billing

• Payments are processed securely through Stripe
• Subscriptions automatically renew unless cancelled
• You can manage or cancel your subscription through the app or by contacting support
• For in-app purchases made through Apple App Store or Google Play, the respective store's payment terms apply

5. 30-Day Money-Back Guarantee

We offer a full refund within 30 days of purchase if you are not satisfied with the service. To request a refund, email us at help.thepeak@gmail.com with your purchase details.

6. Health Disclaimer

The Peak app is designed for general wellness and is not a substitute for professional medical advice, diagnosis, or treatment. Always consult your healthcare provider before starting any new exercise program, especially if you have existing health conditions. If you experience pain or discomfort during exercises, stop immediately and seek medical attention. We make no medical claims regarding the effectiveness of Kegel exercises for any specific condition.

7. User Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials
• You agree not to share your account with others
• You agree to use the Service only for its intended purpose
• You agree not to attempt to reverse engineer, decompile, or disassemble the app
• You agree not to use the Service for any unlawful purpose

8. Intellectual Property

All content, including but not limited to exercise programs, text, graphics, images, animations, and software, is the property of Peak Media LTD EOOD and is protected by copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written permission.

9. Account Termination

By you: You may cancel your subscription and delete your account at any time through the app Settings or by contacting support. Upon cancellation, you retain access until the end of your current billing period.

By us: We reserve the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or misused the Service. No refund will be provided for terminations due to violations.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEAK MEDIA LTD EOOD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Peak Media LTD EOOD and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of your use of the Service or violation of these Terms.

13. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of Bulgaria, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved exclusively in the competent courts of Sofia, Bulgaria. For EU consumers, this does not affect your rights under mandatory consumer protection laws of your country of residence.

14. Third-Party App Store Terms

If you download or use our app through Apple App Store or Google Play Store, you acknowledge and agree that:

• These Terms are between you and Peak Media LTD EOOD, not with Apple Inc. or Google LLC
• Apple and Google have no obligation to provide maintenance, support, or warranty for the app
• Apple and Google are not responsible for addressing any claims related to the app
• Apple and Google are third-party beneficiaries of these Terms and may enforce them against you
• You must comply with the applicable app store terms of service

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Changes to Terms

We reserve the right to update these Terms at any time. Significant changes will be communicated via email or in-app notification at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance of the new Terms.
